Protect Your Independence on Independence Day: Be Aware of DUI Checkpoints

Police in many states occasionally set up sobriety checkpoints at fixed locations on busy highways. Also known as DUI checkpoints or roadside safety checks, these checkpoints are often set up on around holidays where people are likely to be out celebrating, such as the 4th of July. Officers at these checkpoints pull over vehicles and, if a driver appears impaired, will conduct a field sobriety check.

Are sobriety checkpoints legal?

Under federal law, this practice is supported for the most part. Legislators contend that roadways remain safer when checkpoints are implemented. Each state, however, has different laws regarding their legality. For instance, in Wisconsin, sobriety checkpoints are not legal, but in Illinois, including in DeKalb, Cook, and Kane Counties, this practice is perfectly legal.

Who is likely to be stopped?

There is really no way to tell who will be stopped at these types of checkpoints. Officers may stop vehicles at regular intervals -- every 5th, 10th, or 15th driver, for instance -- or stop vehicles randomly.

What to do if you get stopped at a DUI checkpoint

Most of us do not go out to celebrate with the intention of breaking the law by driving impaired. But sometimes the unplanned happens.
